Types Of Bankruptcy

You should know that bankruptcy is a legal way to avoid paying your debts. The Bankruptcy Code is divided by chapters, although most individuals end up needing only Chapter 7 or Chapter 13. Under Chapter 7 bankruptcy, your unsecured debt, such as credit card debt, is discharged. Under Chapter 13 bankruptcy, you create a structured repayment plan to repay some or all of your debts over a three- to five-year period.

Filing bankruptcy puts an automatic stay into effect. The stay puts an immediate halt on any foreclosures, evictions, wage garnishments and creditor harassment.

Credit Counseling

Filing bankruptcy requires you to complete two short courses of credit counseling: one before filing and one after. Our law firm will refer you to a reputable credit counselor in your area who has been approved by the Executive Office of the United States Trustee.

You Are Not Required To Hire A Lawyer

You may file a bankruptcy petition on your own or with or without the help of someone who is not a lawyer. If you choose a bankruptcy preparer or attorney, he or she must tell you in writing exactly what services will be provided and what he or she will cost. Although you are not required to have an attorney, there are a several good reasons to hire one.
