If you are thinking about filing bankruptcy, you probably know that you can probably keep certain assets, such as your house, pension plan and insurance. You many not realize, however, that exemptions vary among states. If you moved to California within the last few months, you may need to file bankruptcy using the exemptions from your previous state.

Do I Qualify For California's Exemptions?

To file bankruptcy in a California district, you must have lived in that district 91 out of the last 180 days. If you do not meet this requirement, you can file under another jurisdiction, or you can wait until you do meet the requirement.

Filing bankruptcy in a California district does not automatically qualify you for California exemptions. Depending on how long you have lived here, you may only be eligible for exemptions from your previous resident state.
